1. RELATIONSHIP between Children, Children’s Family & Donor:
1. SpareTime Global website does not connect children and donors, serving only as an intermediary in order to optimize the sponsorship service for low-income and underprivileged children in Sri Lanka. Thus, the children or donor acknowledges that SpareTime Global Limited has no direct association with the children or donor, it just facilitates contact between a child and a donor by accepting the provision of sponsorships by the donor. The users acknowledge and agree that SpareTime Global Limited is not liable for any act or omissions committed by any user, (by willful misrepresentation, commitment break as a result of any act, discussions, and others including the effective fulfillment of the obligations assumed by the users and loss not being for tax purposes). The user acknowledges and agrees that, by registering and accepting the policy of the service, he/she does so at his/her total means and exclusive risk. SpareTime Global Limited recommends that every interaction is done with good sense.
2. FROM AVAILABILITY AND INCONSISTENCY IN THE SYSTEM:
1. SpareTime Global Limited does not guarantee that the system will be available without any interruption and that it will always be error-free, and therefore, shall not be liable for damages caused to users.
2. You agree that SpareTime Global Limited is also not responsible for any damages or losses caused to your computer as a result of using the website.
3. SpareTime Global Limited is not liable for any error or inconsistency of information with other independent systems, specializing in the service provision for children, children’s families, donors, and teachers.
3. COMPENSATION FOR DAMAGES:
1. User agrees to indemnify and hold harmless Sponsor a child and its representatives from any claims, suits, losses, liabilities, damages, and expenses, including reasonable attorneys’ fees and court costs for the damage they cause.
2. User agrees to indemnify and hold harmless Sponsor a child and its representatives from any accidental claims or suits though that occur due to any user’s negligence or by the fault of the user. Therefore, users agree to indemnify SpareTime Global Limited and its representatives from any type of vicarious liability.
3. Users accept that the Sponsor a child program acts solely as a connecting/matching service between its users (children, children’s families, donors, and teachers) and that it is not responsible for any issues that arise during the interactions, such as willful misrepresentation, willful miscommunication, willful misconduct, delays, or service discomfort, etc.
4. OBLIGATIONS, LIABILITIES, AND RISKS OF USERS
• The User certifies that he/she uses the service of their own free will and untrammeled choice and recognizes and accepts as its responsibility and risk for using the website.
• The acceptance and denial of the sponsorship may occur at first by the donor, who can accept or deny the sponsorship when receiving a notification for a fund transfer. The donor may cancel the sponsorship for any reason. Both recognize that SpareTime Global Limited is not liable for any delays, cancellations, failure to cancel the sponsorship, and miscommunication between users, nor for any delay or failure in the delivery of sponsorships from the donor.
• Users acknowledge and declare that he/she understands and is aware of all the risks involved in the use of the website and obtaining services, pledging to reasonably take care as expected of someone who chooses the service.
• The Users acknowledge and agree that SpareTime Global Limited performs no children selection or no donor selection, simply registering on the website to participate does not vouch for its suitability, legally, physically, or mentally to provide or obtain the services. The users acknowledge that the data provided by other users, such as (i) full name, (ii) address, (iii) telephone number, (iv) profile picture, (v) bank account details, (vi) email address, and others, were provided by the respective users by themselves and that information will be displayed in a limited capacity on the platform. SpareTime Global will not share your personal information with its donors, teachers, beneficiaries, and its business partners. In case SpareTime Global Limited is required to disclose your personal information in order to assist the government authority or in adherence to the court or to protect the interest of SpareTime Global Limited and/or any particular user(s), SpareTime Global will disclose it by obtaining prior permission from you. By accepting the services, the users acknowledge that Sponsor a Child program has no involvement in the contractual relationship between a child and donor, a child’s family and donor, child and teacher, or teacher and donor.
5. GENERAL TERMS AND CONDITIONS
• BOOKING AND CANCELLATION CONDITIONS
  1. The users agree that these terms and conditions shall be deemed to apply when the users use Sponsor A Child website. SpareTime Global Limited shall not be responsible or liable for any loss, damage or embarrassment suffered by the user concerning or in respect of any instructions or operations effected by any other user or purported to be affected by that user https://sponsorachild.online/, however, caused including but not limited to the user’s noncompliance with the services, instructions and Sponsor A Child website‘s inability to provide the services for any reason, including and without limitation, as a result of a malfunction, partial or total failure of any network terminal, data processing system, computer transmission or telecommunications system or other circumstances whether or not beyond the control of SpareTime Global Limited or any person or any organization involved in the abovementioned systems.
  2. The users shall not hold SpareTime Global Limited or Sponsor A Child program liable for any direct or indirect loss or damage which may be suffered by other users as a result of any failure by Sponsor A Child website or any fault of the users to provide a service to the other user within any stipulated time even if SpareTime Global Limited or the particular user have agreed to so provide the service or even if the user has advised SpareTime Global Limited or the user of the possibility that any such loss or damage would result if the Service is not provided at all or within the stipulated time.
  3. The user transacts with SpareTime Global Limited and agrees to indemnify SpareTime Global Limited from and against and in respect of any or all liabilities, losses, charges and expenses (including legal fees and costs on a full indemnity basis), claims, demands, actions, and proceedings which SpareTime Global Limited or Sponsor a child program may incur or sustain directly or indirectly from or by any reason of or concerning the use or purposed use of Sponsor A Child website and shall pay such sums on demand.
  4. The donor can discontinue the sponsorship by providing a 1 months’ notice with written communication stating the reason for canceling the sponsorship. This time frame will be used to find a substitute donor for the child.
  5. If you have not provided accurate information or SpareTime Global cannot get in touch with you, those applications will be rejected.
• PAYMENT CONDITIONS
  1. The donor shall pay the agreed sponsorship amount through a direct transfer to the bank account of sponsored child’s mother or father or guardian.
  2. However, if the donor did not continue the agreed amount to the sponsored child when the sponsorship is due, SpareTime Global Limited will be indemnified from and against and in respect of any or all liabilities, losses, charges, and expenses that occurred to the sponsored child or the sponsored child’s family.
  3. However, if the donor is paying through a direct transfer, standard transfer rules will apply to the same.
• GENERAL TERMS AND CONDITIONS
  1. While technology helps to ensure the speed, dependability, and safety of our services, people matter most to the Sponsor a child program. And it’s a two-way street between our users.
  2. PROFESSIONALISM & RESPECT: Sponsor A Child maintains a zero-tolerance policy regarding all forms of discrimination, harassment, or abuse.
  3. NON-DISCRIMINATION: It is unacceptable to refuse to provide or accept services based on a person’s race, religion, national origin, disability, sexual orientation, marital status, gender identity, age, or any other characteristic protected under applicable Sri Lankan law. This type of behavior can result in a permanent loss of access to the Sponsor A Child platform.
  4. NO INAPPROPRIATE BEHAVIOUR: Users expect each other to act appropriately and respect boundaries. It is disrespectful to make derogatory remarks about a person or group. Furthermore, commenting on appearance, asking overly personal questions, and making unwanted physical or non-physical contact are all considered inappropriate behaviors. Anyone who solicits or engages in sexual conduct while using the Sponsor A Child platform may lose future access to the Sponsor A Child platform. We encourage you to be mindful of other users' privacy and personal space. Violence of any kind will not be tolerated.
  5. HUMAN KINDNESS: Calm and clear communication is the most effective way to defuse any disagreement that may arise between you and other users. All users expect to be treated with respect and courtesy by one another. This expectation extends to personal property as well. As a user, it is your responsibility to treat your other user with respect and not intentionally damage or remove their personal information or belongings. As a user, it is your responsibility to make every reasonable effort to refrain from such activities in your capacity. It is best to treat each other respectfully. It is unacceptable to require additional funds/payments from a donor; doing so could cause you to lose access to the Sponsor A Child platform.
  6. SAFETY: The safety of users on the Sponsor A Child platform is of utmost concern. To best protect everyone in the process, we require the following: compliance with the law concerning illegal substances (unless explicitly allowed by law), and open containers of alcohol are not permitted. This is against the law and a serious violation of Sponsor A Child’s policy. Furthermore, SpareTime Global does not tolerate drug or alcohol use by users while using the Sponsor A Child platform. If a user believes other users may be under the influence of drugs or alcohol, please end the service immediately and inform SpareTime Global Limited, and any user has the responsibility not to give any kind of assistance to a user under the influence of drugs or alcohol. Sponsor A Child prohibits human trafficking of any kind, including the commercial sexual exploitation of children, while using our platform. Anyone who engages in such activity may lose access to Sponsor A Child. As a user, it is your responsibility to engage with other users safely in accordance with the rules of your city. Servicing when you’re drowsy can cause serious misconduct or accidents. As a user, it is your responsibility to abide by appropriate laws in your state (When required).
  7. DISABILITIES: Sponsor A Child expects compliance with all Sri Lankan laws governing providing services to people with disabilities. However, the users have the sole discretion to refuse to give services to a user with a disability. Not following the rules or violations of these terms could result in the loss of your Sponsor A Child account. Please report any violations to Sparetime Global Limited, we want to hear your feedback! Alert us and we’ll take action!
  8. EMERGENCIES: If at any time you feel that you are faced with a situation that requires immediate emergency attention, please call the emergency service number in your area or call Sparetime Global Limited through the provided contact information. Once all parties are safe and the situation has been handled by the authorities, please then notify Sparetime Global Limited. We will assist and take appropriate action as needed, including cooperating with law enforcement.
6. TERMINATION
1. Most content and features on the website are made available to visitors free of charge. However, Sparetime Global Limited reserves the right to terminate access to certain areas or features of the website at any time for any reason, with or without notice. Sparetime Global Limited also reserves the universal right to deny access to particular users to any/all of its services without any prior notice/explanation to protect the interests of Sparetime Global Limited and/or other visitors to the website. Sparetime Global Limited reserves the right to limit, deny or create different access to the website and its features with respect to different user(s), or to change any of the features or introduce new features without prior notification.
